I was sent medical/billing information for someone else. This same company has been lax with privacy issues towards my own information.

Thanks for writing dLife. Yes, you would contact the U.S. Department of Health and Human services, the Office of Civil Rights. The website for this information is www.hhs.gov/ocr Best of luck to you!

I work in the healthcare field and HIPPA is a serious violation. Most violations are inadvertent. For a violation to occur, it must be intentional. The hospitals and insurance companies are allowed to share information with each other, as well as anyplace that would be involved with billing, up to and including collection agencies!! That being said, if this is a true and intentional HIPPA violation, then you should file a claim. However, if this is an unintentional accident (they may not even know that they are sending stuff to the wrong person unless you contact them to let them know) then I suggest talking to the company first to resolve your complaint about your own issues and to at least let them know they are sending private stuff to the wrong person. It may have simply been a "wrong click" on a computer keyboard. For example, if I am on the floor, I am only allowed to look up the patients that I care for, but on occasion, I accidentally click on somebody else who may have the same last name. This is not a hippa violation, even though I have no authorization to look at that person's chart. Also, when faxing and emailing, sometimes, wrong numbers are entered or even programmed into the computer. If this is the case, this is also not a violation, b/c it is accidental. Now, if I contact you and tell you that your friend, Sally Patient is in the hospital for such and such and having this procedure and things like that, that is a violation. Before risking somebody's job, make sure you have a true violation!!!
